Bedbug Laws By State

 

With the serious increase of bedbug infestations over the past decade, many victims of such infestations are wondering what the bedbug laws are in their state. Currently, twenty-two states have bedbug laws in the books. Several other states have bedbug legislation, or yet to be passed bedbug laws. Here is a compiled list:

Alabama

Law	Definition
Alabama Administrative Code 420-3-11-.12 Insect And Rodent Control: Section 2	Guest rooms and other areas of a hotel found to be infested with bed bugs shall be subject to immediate closure until effective treatment, eliminating pests, has been administered. A State health official shall declare the problem abated before the room or area is reopened to guests.

Arizona

Law	Definition
Arizona Revised Code 36-601 – Public Nuisances Dangerous to Public Health.	Any place that offers sleeping accommodations, and has bedbugs, is a public nuisance and dangerous to human health.
Arizona Revised Code 9-500.31 Prohibition on adopting landlord tenant bedbug control requirements.	Arizona cities/town cannot regulate landlord-tenant bedbug controls. They can regulate disposal of bedbug infested materials.
Arizona Revised Code 11-269.11 Prohibition on adopting landlord tenant bedbug control requirements.	Boards of Supervisors cannot regulate landlord-tenant bedbug controls. They can regulate disposal of bedbug infested materials.
Arizona Revised Code 33-1319 Bedbug control; landlord and tenant obligations; definitions.	A landlord cannot knowingly rent a bedbug infested property to a tenant, and must provide tenants with bedbug literature.

California

Law	Definition
California Code Of Regulations 40- Bedding	Hotels, apartments, and linen supply companies must ensure all materials are bedbug free.

Connecticut

Law

Definition

Sec. 22a-46. Short title: Connecticut Pesticide Control Act

In Connecticut, the Department of Energy and Environmental Protection (DEEP) classifies each registered pesticide as either acceptable for general use or restricted use. Restricted use pesticides are recognized in the industry to generally cause unreasonable adverse effects on the environment. Restricted use pesticides may be applied only by a certified applicator or under the direct supervision of a certified applicator.

Florida

Law	Definition
Florida Revised Code/Title VI/Civil Practice and Procedure/Chapter 83- Landlord and Tenant	The extermination bedbugs. When vacation of the premises is required for such extermination, the landlord shall not be liable for damages but shall abate the rent. The tenant shall be required to temporarily vacate the premises for a period of time not to exceed 4 days, on 7 days’ written notice, if necessary, for extermination.

Illinois

The State of Illinois and the City of Chicago is in the process of drafting bedbug laws. The city of Chicago was recently labeled the #1 infested bedbug city in the U.S. The new laws are expected to be voted on March 13, 2013.

Illinois Proposed Bedbug Laws

The presence of bedbugs is a public nuisance.

Bedbugs require pest control management done by a pest control professional.

Bedbug infestations require records to be kept on infestations and actions taken.

City and State employees will be granted access to the above mentioned reports.

Requires each condo and co-op to develop a plan for detection, inspection and eradication of bed bugs.

Regulates disposal of contaminated materials and sale of used mattresses and beds.

A sample plan for detection, inspection, and eradication of bedbugs will be posted on the State’s Department of Public Health website.

Laws will spell out both landlord and tenant responsibilities when it comes to bedbugs.

The Commissioner of Public Health has the power to enforce these laws.

Iowa

Law	Definition
Iowa Administrative Rule 138.13 Conditions For Migrant Labor Camps Permits	A migrant labor camp must have bedbug controls in place; and take effective pest control measures against any bedbug infestations.

Kansas

Law	Definition
Kansas Administrative Regulations Article 36 /28-36-77.—Food Service Establishments, Vending machines, and Lodging	The presence of bed bugs, which is indicated by observation of a living or dead bed bug, bed bug carapace, eggs or egg casings, or the typical brownish or blood spotting on linens, mattresses, or furniture, shall be considered an infestation. The presence of bed bugs shall be reported to the regulatory authority within one business day upon discovery or upon receipt of a guest complaint. All infestations must be treated by licensed pest control operator.
Kansas Administrative Regulations Article 4-27-9 Bedbugs Imminent Health Hazard	Bedbugs are considered a health hazard, which must be reported to authorities within 12 hours of detection.

 

 

Maine

Law

Definition

Maine Revised Statutes-Title 14: 6021-A. Treatment of Bedbug Infestation

Landlord must: Inspect the unit for bed bugs within five days of being notified by tenant of infestation, contact pest control agent within 10 days of determining there is an infestation, take reasonable measures to effectively identify and treat bed bug infestation as determined by pest control agent. The pest control agent must carry current liability insurance. Before renting a dwelling unit, a landlord must disclose to a prospective tenant if an adjacent unit is currently infested with or being treated for bed bugs; including the last time the property was inspected and labeled bedbug free. Landlord may not offer for rent a dwelling unit the landlord knows or suspects is infested with bed bugs.Tenants must: Promptly notify a landlord when they know of or suspects an infestation of bedbugs in their unit, and then grant the landlord and pest control agent access to the unit. Tenant must comply with reasonable measures to eliminate and control a bed bug infestation as set forth by the landlord and pest control agent or risk being financially responsible for all pest control treatments of dwelling unit arising from the tenant’s failure to comply.Law also provides bedbug remedies.

Michigan Administrative Code 400.57 Care Of Residents	Requires county infirmaries to implement procedures to prevent bedbug infestations and to take proper steps to eradicate existing infestations.

Minnesota

Law	Definition
Minnesota Administrative Code 4625.1700 INSECT AND RODENT CONTROL	Every hotel, motel, lodging house, and resort shall be so constructed and equipped as to prevent the entrance, harborage, or breeding of bedbugs, and specific means necessary, for the elimination of such pests such as cleaning, renovation, or fumigation shall be used. The commissioner may order the facility to hire an exterminator licensed by the state to exterminate pests when:A. The infestation is so extensive that it is unlikely that a nonprofessional can eradicate the pests effectively; orB. The extermination method of choice can only be carried out by a licensed exterminatorC. Upon re-inspection, it is found that an establishment has not been brought into compliance with a prior order to rid the establishment of pests.
Minnesota Administrative Code 4665.2300 INSECT AND RODENT CONTROL	Every supervised living facility shall be so constructed or equipped as to prevent the entrance, harborage, or breeding of bedbugs. Cleaning, renovation, or fumigation by licensed pest control operators for the elimination of such pests shall be used when necessary.

Nebraska

Law	Definition
Nebraska Administration of Rules & Regulations Title 175, Ch. 2, 004 SANITATION	Boarding homes must be built to prevent the infestation of bedbugs, and pest control operators can be used to treat infestations.
Nebraska Administration of Rules & Regulations Title 175, Ch. 3, 004 HEALTH AND SAFETY REQUIREMENTS – GENERAL	Health care facilities must be built to prevent the infestation of bedbugs, and pest control operators can be used to treat infestations.

Nevada

Law	Definition
Nevada Revised Code 447.030 Extermination	Any room in any hotel in Nevada that is infested with bedbugs shall be thoroughly fumigated, disinfected and renovated until such bedbugs are entirely exterminated.
Nevada Revised Code 444 Sanitation	In a camp, proper bedbug prevention measures must be taken.

New York

Revised Statute New York City Administrative Code 27-2018.1 Notice of Bedbug Infestation History	A property’s bedbug infestation history for the previous year, regarding the premises rented by the tenant, and the building in which the premises are located, shall be furnished to each tenant.
New York Education Code/Article 19 MEDICAL AND HEALTH SERVICE 920. Public Schools	Public schools; infestation of bedbugs1. In a city school district having a population of one million or more inhabitants, the principal of each public school shall provide immediate notification to parents, persons in parental relation or guardians of potentially affected students attending the school, disclosing a findingrelating to the infestation of bedbugs in such school; provided, however, that if pursuant to regulations of the commissioner it is determined that any infestation is contained within a discrete area, the principal may limit such notification to parents, persons in parental relationship or guardians of all potentially affected students within such area, and shall advise the parents’ association of the scope of such notification.2. Along with the notification required pursuant to subdivision one of this section, the principal of such public school shall also include information regarding proper procedures to prevent further infestationsat the school and to prevent the transfer of bedbugs. Such information shall be developed by the board of education in consultation with other city agencies and shall be available in various languages as deemed necessary.3. The principal shall ensure that the bedbug infestation at the school is properly addressed in the most effective and safe manner.

 

Ohio

Rhode Island Administrative Code 25-3-24:7 Rules & Regulations Relating To Pesticides	Certain restricted bedbug pesticides must be certified for commercial use.

South Dakota Administrative Code/44:02:08-Vacation Homes	A vacation home establishment must be constructed, equipped, and maintained to prevent the entrance, harborage, or breeding of bed bugs. Specific means necessary for the elimination of such pests, such as cleaning, renovation, or fumigation, must be used. The department may require the facility to hire a professional exterminator to exterminate pests.

Texas Revised Code Sec. 341.011. NUISANCE	Bedbugs are a public health nuisance.
Texas Revised Code Sec. 341.012. ABATEMENT OF NUISANCE	(a) A person shall abate a public health nuisance existing in or on a place the person possesses as soon as the person knows that the nuisance exists.(b) A local health authority who receives information and proof that a public health nuisance exists in the local health authority’s jurisdiction shall issue a written notice ordering the abatement of the nuisance to any person responsible for the nuisance. The local health authority shall at the same time send a copy of the notice to the local municipal, county, or district attorney.(c) The notice must specify the nature of the public health nuisance and designate a reasonable time within which the nuisance must be abated.(d) If the public health nuisance is not abated within the time specified by the notice, the local health authority shall notify the prosecuting attorney who received the copy of the original notice. The prosecuting attorney: (1) shall immediately institute proceedings to abate the public health nuisance; or (2) request the attorney general to institute the proceedings or provide assistance in the prosecution of the proceedings, including participation as an assistant prosecutor when appointed by the prosecuting attorney.

Utah

Law	Definition
Utah Administrative Code Rule R392-200. Design, Construction, Operation, Sanitation, and Safety of Schools.	Effective measures intended to minimize the presence of bedbugs on the premises shall be utilized. The premises shall be maintained so that propagation, harborage, or feeding of is prevented.

West Virginia Revised Code 16-6-16 Bedbugs	In every hotel, any room infected with vermin or bedbugs shall be fumigated, disinfected and renovated until said vermin or bedbugs are extirpated.

 

Wisconsin

Law

Definition

Wisconsin Administrative Code Department Health Services 190.08

(5) PEST CONTROL(a) Screens. All windows and doors used for ventilation purposes shall be provided with wire screening of not less than number 16 mesh or its equivalent and shall be properly maintained to prevent entry of insects. Screens for windows shall cover at least one third of the window area. Screen doors shall be self closing.(b) Eradication. All means necessary for the elimination of rodents, flies, roaches, bedbugs, fleas, lice and other householdpests shall be used. Extreme care shall be taken in the use of poison to prevent accidental poisoning of domestic animals and people.(c) Labeling and storage of poisonous compounds. Containers of all poisonous compounds used in the extermination of rodents or insects shall be prominently and distinctly labeled for easy identification of contents. Poisonous compounds shall be stored independently and separately from food and kitchenware.

Pest Of The Week: Argentine Ant

 

Routinely found underneath the moist areas of your property, Argentine ants build their nests under rocks and other debris. They can also build nests inside your home, as they enter looking for their favorite sweets. Argentine ants are located in the Southeast U.S., Washington, Oregon, and California.

Argentine ants are a grayish-brown in color, and are approximately 1/8 inch long. Colonies can have multiple queens, and tens of thousands of worker ants, as different colonies join forces. These ants are notorious for driving out other ant species.

Argentine ants love anything sugary and sweet. These ant pests will commonly eat the nectar that plant aphids provide for them In exchange; Argentine ants will protect the aphids from other predators.

One of the most effective pest control approaches to exterminating the Argentine worker ants and queens is to actively bait this pest with poison; concealed in sugar. Once the Argentine ants have returned the bait to the nest, the remaining colony will soon die off.

I recently had a lot of fun putting together a Spotify playlist of popular bug songs. While putting it together, I found several bands that also shared their names with pests. Here is my top ten bands named after bugs or pests:

10. Katydids

The Katydids reached stardom briefly in the early 90’s before guitarist Adam Seymour left the bad to play with The Pretenders. Before splitting, The Katydids released two moderately successful albums entitled Katydids (1991) and Shangri-la (1991).

 

Katydids, also known as long-horned grasshoppers, are best known for their appearance that mimics that of a leaf.

9. Adam and the Ants

Adam and the Ants, led by singer Adam Ant, became notable as a British cult band during the late-1970s punk rock era. Adam and the Ants have had a major influence on artists like Nine Inch Nails and Fat Boy Slim during the band’s short career.

Ants are one of the most successful groups of insects, and a common pest. They are social insects that live in underground colonies, but many enter buildings looking for food.

8. Iron Butterfly

Iron Butterfly rose to fame in the late 1960’s. They were even booked to play at Woodstock, but were unable to after getting stranded at the airport. Their album, In-A-Gadda-Da-Vida is one of the world’s 40 top-selling albums, selling more than 30 million copies.

While Butterflies are generally not considered pests, some species can damage domestic crops or trees in their larval stages. Traditionally, butterflies are a popular motif in the visual and literary arts across many different cultures.

7. Papa Roach

Papa Roach has sold more than 18 million album copies worldwide, and are best known for their songs “Last Resort”, and “…To Be Loved.” Their music is best described as rap metal. Their first album, Infest, reached triple platinum in 2000.

Roaches are one of the most common and hardy household pests in the United States. They invade our homes looking for their favorite foods like sugary sweets, salty snacks, and even hair or fingernails.

6. Alien Ant Farm

Alien Ant Farm got their name from a dream guitarist Terry Corso had about aliens cultivating the human race, like we were all in an ant farm. The band has had four successful albums, and has contributed to several Hollywood movie soundtracks; including 2002’s Spiderman. Their most popular song is “Smooth Criminal.”

The United States hosts almost 1,000 different species of ants. While they are considered one of the most common household pests, only 25 species commonly infest homes.

5. Ratt

One of the biggest bands in the early 80’s glam metal scene was Ratt. Their songs “Round and Round,” “Lay It Down,” and “Wanted Man” helped to launch the band into superstardom.

Rats are very common household pests during the colder winter months. If you are seeing droppings, fresh gnawing, or tracks near your property; chances are you might have a serious rat infestation.

4. Buddy Holly and The Crickets

Even though Buddy Holly and The Crickets’ success was short lived because of an unfortunate plane crash, they may be one of the single most influential creative forces in early rock and roll. “That’ll be the Day” is the group’s most popular recording; and in 2011 Buddy Holly was given a star on the Hollywood Walk of Fame.

Crickets are best known for their characteristic chirping noise, used by males to attract female crickets. As the temperatures rises, their songs become louder and faster.

3. Scorpions

Just by listening to “Rock You Like a Hurricane” before any football game, one comes to the realization that Scorpions are one of the greatest hard rock bands of all time. In case you need any more proof, the band has sold over 150 million records, released 23 albums over the last 40 years, and played around 5,000 concerts in over 80 countries.

Much like the band, scorpions have been around a long time and are incredibly resilient. They require a focused pest control strategy. A testament to their durability was proven when lab experiments froze scorpions for weeks, leaving them unharmed when they were thawed. On top of that, after U.S. nuclear testing scorpions were discovered near ground zero with no adverse side effects.

2. Bee Gees

The Bee Gees, made up of brothers Robin, Maurice, and Barry Gibb were one of the biggest recording artists during the late 60’s to early 70’s. During the group’s 45 years of stardom, only Elvis Presley, The Beatles, Michael Jackson, Garth Brooks and Paul McCartney have outsold them.

While bees are considered beneficial insects by pollinating plants, they earn the title of pest by stinging and contributing to several deaths a year; common when a sting victim has a severe allergic reaction.

The Beatles are the most commercially successful and critically acclaimed act in the history of popular music. John Lennon, Paul McCartney, George Harrison, and Ringo Starr have sold 177 million albums in the US, more than any other artist.

Beetles constitute almost 25 percent of all known life-forms; more than any other order in the animal kingdom. There are some species of Beetle that have been awarded the distinction of pest. A few include: the Colorado potato beetle, the boll weevil and the Carpet beetle. They repeatedly create insect control problems when they invade and destroy household items and agricultural crops.

Pest Of The Week: House Dust Mite

 

One of the leading causes of asthma and other respiratory allergic symptoms is the house dust mite. These teeny, tiny mites are so small that they are best seen through a microscope; although they can sometimes be seen by the naked eye, in large numbers, if they are placed on a dark background. House dust mites are rectangular in shape, and are a creamy blue color. House dust mites are most commonly found in the carpets, furniture, mattresses and bedding of your home.

Since house dust mites reproduce and multiply so rapidly, pest control professionals, and health officials warn of serious health problems that they can cause. Typical symptoms of house dust mite allergies include itchiness, sneezing, inflamed or infected eczema, watering/reddening eyes, or sneezing repeatedly and frequently.

Ah, Valentine’s Day… A day of love… A day of romance.

This week loving couples across the country are making romantic plans in anticipation for the big day. Reservations are being made at the finest restaurants. Bouquets of beautiful red roses and boxes of expensive chocolates will be at a premium as couples pull out all the stops to show that special someone just how much they are loved.

Getting “Unlucky” On Valentine’s Day

After a romantic Valentine’s Day dinner, you head home with that special someone. Upon arrival, you have Barry White softly playing in the background. You blindfold your date. She is guided upstairs through a trail of rose petals that lead to a candlelit bubble bath. As you remove her blindfold, any chances of getting “lucky” this Valentine’s Day are suddenly vanquished.

A Roach Is Not A Love Bug

An ill-timed visit from a cockroach can turn an intimate Valentine’s date into a nightmare, complete with screaming and attempts to flee.  The sight of a roach can induce a primitive reaction of disgust, nausea, and even vomiting with your date; sucking out all the day’s romance and ensuring your previous gestures are overlooked.

Pest Of The Week: Armyworms 

 

Armyworms are the caterpillar life stage of a moth. Also called Fall Armyworms, these pests have been discovered in most regions of the United States, and have increased in severity; over the past few years. These species of caterpillars are approximately 1.5 to 2 inches in length, dull yellow to gray, with stripes running down the length of their body.

The Armyworm’s name is derived from its feeding habits. Quite simply, this pest will eat everything in an area, and once the food supply is exhausted; the entire “army” moves to the next available food source. If left to multiply, Armyworms can cause widespread damage to agricultural grass crops, such as small grains and corn, and because of this; are regarded as a serious agricultural pest control problem.

Populations of armyworms are typically kept in check by natural means, though population booms can occur, generally after a drought. The best way to avoid lawn pests is to keep grass healthy Grass that is dense and deep-rooted will shrug off a bit of nibbling.

In a lab in Montreal, Quebec (Canada), a McGill University researcher has successfully induced the growth, of what he calls “super-soldiers.” Using ants as an example, this researcher has demonstrated that the potential for Incredible Hulk-like results, exists in all species; including human beings.

He insists that any time you have a mismatch, between the normal environment of an organism and its genetic potential, it will encourage the development of new characteristics. Furthermore, these evolutionary changes can manifest themselves in dormant genes, that remain locked in place for millions of years, until one day they are triggered to re-emerge; by the introduction of a specific environmental condition or conditions.

“Birds with teeth, snakes with fingers, and humans with apelike hair – these are ancestral traits that pop up regularly in nature,” said the McGill University researcher.

Believe it or not, for the last thirty-five to sixty million years, ants have retained this “ancient DNA;” to create super soldiers. And, as the the result of a genetic slip they can appear in the wild, sometimes discovered in the deserts of America; and Mexico. These incredible freaks of nature, can grow to double or triple their normal size, with enormous oblong heads and giant vicious mandibles; that they use to aggressively defend their colonies from attack.

Will these gi-ants eventually get bigger and bigger, until one day they decide to invade cities and towns? Not likely. Thankfully, the laws of physics and the Square-Cube Law, restrict the size potential of an ant. Quite simply, the bigger an ant is, the less likely it will be able to support; its own weight. However, insect control experts say that their is some cause for concern, when hypothesizing the potential problem; of super ants. Because an ant colony is considered (by some) to be one giant organism comprised of many parts, it already requires a focused and aggressive pest control strategy; to eliminate. Therefore, an invasion of super ants might one day require the help of a super ex-terminator… like Arnold.

As the chilly fall and winter weather arrives, families are getting cozy in their warm houses and homes. Not surprisingly, common pests as small as ants or spiders and as big as rats, have the exact same notion. A homeowner’s only hope against the relentless invasion of these pests, is to seal-off any structural, window and door cracks or holes, that could possibly allow pest invaders; to enter to the dwelling or structure.

The most likely points of entry for pests, are a building’s windows and doors. If you often leave your door or windows open, they should be fitted with a proper screen, that is free from any holes, cuts or tears; to avoid inviting a pest control problem into your home. When inspecting the interior and exterior of your dwelling or building, look for light shining through cracks and use your hand to feel for air

movement. If you discover problem areas, seal the cracks around window and door frames with caulking or foam, and apply weather-stripping and sweeps; to seal the moving parts of the door.

Aside from tiny pests like ants and spiders, small rodents like mice are a common pest problem, in the fall and winter months. These unwanted house guests can find their way through a hole, not much bigger than a dime. Once inside a structure and sheltered, they can quickly multiply into a serious pest, bug or insect control problem, for unsuspecting property and home owners. Therefore, as an added precaution and level of protection, it is recommended that glue traps be placed in the attic and other possible pest-prone areas. These sticky traps are able to grab both rodents and insect problems, so if pests do manage to invade parts of your home, you will know what you are up against; before a serious infestation develops.
